    Hi Gary. I had a replacement hip surgery about 3 years ago. Immediately after the surgery everything seemed to be ok so I thought the results were fine.
    It is about your health – first and foremost. Get to a doctor so they can treat you and get better.
    Now let’s address the potential legal issues here.
    In the last few years, there have been hip implants recalled by various medical device companies.
    The two biggest recalls garnering the most media attention were:
    (1) DePuy Hip Recall. These hips were manufactured by the Johnson & Johnson Co.

    The specific hips recalled were the DePuy ASR and some DePuy Pinnacle models.

    On Nov. 19, 2013, Johnson & Johnson & its DePuy subsidiary announced that they will pay at least $2.5 Billion dollars to settle thousands of individual lawsuits.

    The hips being recalled are the Stryker Rejuvenate Modular and the ABG II Modular Neck Hip Stems.

    . Repeated dislocations

    These implants may also cause a potentially very serious health condition called Metallosis.
    Here are just a few of the health issues people can experience from metallosis:

    . Cardiovascular problems

    . Thyroid problems

    (1) The voluntary recall followed the discovery that the devices are prone to “fret and corrode”
    (2) You may be entitled to compensation if you received one of these Stryker implants and you are experiencing pain, swelling and immobility

    (4) You should also consult with your surgeon to find out if you need a revision surgery

    “Gary – I’d love to have your advice on this. And then it happened. This elderly woman pulls out of a fast food restaurant’s parking lot. She was trying to turn left and pulled out in front of me. I broke my right ankle and actually had to have surgery on it because it was really messed up.

    * In 2011 in Georgia, there were 149 motorcycle accident fatalities.
    * Most of the motorcycle accidents in Georgia occur within the metro-Atlanta area.
    * But the majority of the motorcycle related deaths in Georgia occur on rural roads versus city streets.
    * Motorcyclists are 35 times more likely to experience a deadly accident on the road than those in passenger cars.
    * A 2009 report from the Insurance Institute for Highway Safety showed that 42% of fatal motorcycle crashes involved a vehicle turning left while the motorcycle was going straight, passing, or overtaking the vehicle.
    And Glenn – that is what you said happened in your wreck. The at fault driver was attempting to turn left out of the fast food restaurant driveway when she pulled out in front of you.
    Now what is the main reason these motorcycle accidents happened?
    The driver of the other vehicle did not see the motorcycle before the collision, or did not see the motorcycle until it was too late to avoid a collision.

    First – from the perspective of the person riding the motorcycle.
    Here are 5Tips I’d like to share:
    (1) Perform a Bike Safety Check BEFORE you ride!
    Start with the tires. Make sure they are property inflated by using a good tire pressure gauge.
    Look at your tires to see if they have any surface cuts or foreign objects in them.
    Check your lights, turn signals and brakes. Please make sure they are in working order.

    And this really does apply to all of us, not just to motorcycle riders.

    (3) Wear a quality protective helmet.
    Head injury is the #1 cause of deaths in motorcycle crashes.

    In 2008 in Georgia, 97 motorcyclists lives were saved because they were wearing a proper helmet at the time of their crash.
    Georgia requires all riders and passengers to wear a helmet.

    Make it a habit to do this – even in daylight hours.
    This is just one other factor that may help you be seen by other drivers.
    (5) Wear high visibility, protective clothing.

    And it is always a good idea to wear thick pants, boots, shirts with long sleeves or a heavy protective jacket.

    ALWAYS check your blind spot before changing lanes or merging into traffic. Motorcycles can be harder to see than other types of vehicles.
    You should always double check to make sure the road is clear before you pull into a roadway from either a stop sign, a yield sign, or a driveway.
    Let’s be attentive to the road when we operate our vehicles.
    (2) Keep your eyes on the road!
    Please put down that cell phone when you are behind the wheel.

    Glenn: you were hurt in this wreck because the other driver pulled out in front of you.
    She received the ticket for failure to yield.
    However, just because she was cited for causing the wreck does not mean her insurance company is going to compensate you fairly for your injuries.

    Insurance adjusters are trained to act like your long lost friend. They will tell you things like “You don’t need a lawyer. We are here to help you.”
    And as soon as they hang up the phone with you, they pick up the phone to speak with THEIR lawyer.

    So just by talking with a lawyer the injured victim received 40% more money than when they tried to handle the claim on their own.

    Suppose an injured victim that DID NOT have an attorney settled their claim for only $3,000.00. If they had hired an attorney, they could have settled the case for $10,500.00.

    Jason, let’s start with the question “Do I need a lawyer?” What do you think?

    Gary: Well let’s talk about the process. I know the social security administration has a 5 step process they follow to determine if a person is disabled and eligible for disability benefits.

    Step #1:
    Are you working?
    The social security administration wants to know if you are working. Explain that for us.

    Is your condition severe according to the Social Security Administration Guidelines?
    What does that mean?

    Gary: Step #3:

    Explain this step for us.
    Jason: Sure. The social security administration has 2 lists of conditions that it considers disability. One list is for kids, the other is for adults.

    The list is broken down into 14 categories by body system.
    These include musculoskeletal, your senses – including speech, respiratory, and cardiovascular.
    If the applicant’s condition is not listed, then the department will determine whether or not the condition is equal to one of those disabling conditions on their list.
    Gary: Step # 4:

    Gary: Assume someone gets through this 5 step process. what are the chances the person will be approved for social security disability on their initial application?
    Jason: Very poor. Between 1999 and 2009, on average only 28% of social security disability claims were approved on the initial application.

    Jason: Then you start the appeals process. There are various time deadlines that apply to these appeals. If you don’t file the appeal within the deadline, you have to start the process all over again.

    This is different kind of question and I hope you can help. Our daughter just turned 16 and recently passed her driving test to get her license. I really want to be proactive in working with her on various things about the car. I’ve taught her how to check the oil level in the car, check the tire pressure, and she even knows how to change a tire if she were to ever get a flat.

    Rodney – thanks for the question and that is a great one!
    First of all, let me commend you for being so proactive in working with your daughter.

    * In the U.S., the risk of a teen driver between the ages of 16-19 being involved in a car wreck is 4 times higher than that for older drivers.

    * 28 will be involved in accidents.

    * 1 will be killed in a car crash.
    And let me share with you a study on drivers’ education that was conducted by George Mason University in Virginia. This may give us a little clarity on why teenagers may be more likely to be involved in accidents when they get behind the wheel.
    * “Teens, on their part, view driving as a right rather than a privilege. Overwhelmingly, study participants cited teen drivers’ inexperience as well as their feeling of invincibility and willingness to take risks as contributing factors in unsafe driving behaviors. Participants also noted that teen drivers are easily distracted and lack the skills and judgment necessary to recover from unexpected incidents. ”
    * This same study concluded that parental involvement was the most important factor in teaching teens safe driving habits and behaviors.
    We, as parents, can’t rely on the traditional driver’s education programs at school to adequately prepare our teens to get behind the wheel.
    There was a report that came out in September 2006 by the Insurance Institute for Highway Safety that discussed the drivers’ education programs in schools. The report suggested that the education does not adequately make our students safer drivers. The way for us to lower the risks of teens being involved in crashes is to:

    * If someone is injured, call 911 immediately!
    * ALWAYS call the police to come to the scene to complete an incident report. The investigating officer will help document the scene of the wreck, gather the facts, interview witnesses, and prepare a report. If you don’t do this, it could be your word against the other driver.
    * Exchange information with every person involved in the wreck, including:
    -Name

    -License plate
    -Insurance information
    * Also get the same identifying information for any witnesses.
    * If you have a smart phone or camera, take pictures at the scene if possible.
    Include property damage to all cars, and any debris in the road at the scene.
    * Report the wreck to your insurance company – even if you were not at fault. This is especially important if it appears the other driver did not have insurance.
    DON’TS

    * Don’t accept blame for the wreck unless you have an opportunity to discuss the facts of the wreck with your attorney.
    * Don’t talk with the insurance company – or sign any papers with the insurance company – until you have a chance to discuss it with your lawyer.

    You really need to the extent and severity of your injuries before you ever consider settling your claim.

    They dangle a quick offer in front of you and encourage you to settle.

    You take the quick money and sign the release.

    What can you do now?
    If your case is settled, you are out of luck! Case closed. No more money – and it doesn’t matter how bad your injuries turn out to be or how much your medical bills are.
    And insurance companies are getting away with this tactic every day.
